The primary focus lies on a significant challenge that permeates this system: violence. Additionally, the research highlights historical considerations shaping the entire process, providing an in-depth perspective on the specific scenario in Tocantins. The choice of this theme is grounded in identifying a relevant gap in the Penitentiary System, especially regarding public policies and governmental support. This gap becomes evident in the pursuit of knowledge and understanding of the configuration of this complex space. The adopted methodological approach involves bibliographic research, encompassing books, articles, journals, and contemporary sources, as well as a documentary analysis of laws, codes, ordinances, and journalistic materials available on reliable websites. Bibliographic sources are properly referenced and highlighted in notes throughout the text, aiming for transparency and facilitating the reader's comprehension of the connections and results obtained. The conclusions drawn from this research point to the intellectual outcomes and ideas developed during the study. The broad perspective adopted allows for a critical analysis of reality, revealing a delicate and complex situation concerning the Penitentiary System. It underscores the need for more effective approaches and policies to address the challenges faced by this crucial system for society. A presente monografia, intitulada "Sistema Penitenciário, Violência e Responsabilidade Estatal: Uma Análise com Ênfase no Estado do Tocantins", visa aprofundar a compreensão do Sistema Penitenciário, especialmente no que diz respeito à proposta de reintegração prevista na Lei de Execução Penal (LEP), e analisar a maneira como o Estado assume responsabilidades nesse contexto. O foco principal recai sobre um desafio significativo que permeia esse sistema: a violência. Além disso, a pesquisa destaca considerações históricas que moldam todo o processo, oferecendo uma perspectiva aprofundada do cenário específico no Tocantins. A escolha desse tema está fundamentada na identificação de uma lacuna relevante no Sistema Penitenciário, especialmente no que tange às políticas públicas e ao amparo do poder público. Essa lacuna revela-se na busca por conhecimento e compreensão da configuração desse espaço complexo.
