Although the National Education Guidelines Act generally orients education towards citizenship and the National Curriculum Parameters cover broader propositions, the theme is still very discursive and conceptual. A possible approach would be teaching fundamental rights as a specific discipline in the High School, and how they are essentially presented in the constitutional legislation. It would also include the incidence of these rights in international law would also be learned, so that their compliance can be demanded by the subjects of rights within the legal provisions. It is understood that the instrumentalization of citizens in this sense may provide a re-signification in the existence of social subjects and that the exercise of rights leaves the plane of political speeches for an effective realization. A qualitative bibliographical research will be used for the study. Este trabalho se propõe a apresentar uma discussão sobre educação e direitos humanos na medida em que esses direitos possam sair de um plano de conceitos abstratos e possam, efetivamente, fazerem parte do dia a dia de cada cidadão. Embora a Lei de Diretrizes e Bases da Educação Nacional oriente, num plano geral, a educação para a cidadania e os Parâmetros Curriculares Nacionais a expandam em forma de proposições mais amplas, ainda assim, o tema é muito discursivo e conceitual. O que se propõe é que o ensino dos direitos fundamentais seja ministrado como disciplina específica do Ensino Médio, fundamentalmente no formato em que se apresentam, principalmente, na legislação constitucional. Que se conheça ainda nesse plano, a incidência desses direitos na lei internacional, de forma que seu cumprimento possa ser demandado pelos sujeitos de direitos dentro das disposições legais. Entende-se que a instrumentalização dos cidadãos nesse sentido poderá proporcionar uma ressignificação na existência dos sujeitos sociais e que o exercício de direitos deixe o plano dos discursos políticos para uma efetiva realização.
