The general objective is to understand the context in which the Brazilian school library is inserted, through its origin, the parameters that regulate it, its function in the school; and as a specific objective to demonstrate the reality of the school library before referred Law. The used methodology was based on bibliographic and documentary research using historical facts, legislation, statistical data and other bibliographies referring to the theme. The document selection was directed through subjects that deal with the presence or absence of the library in the school, the role of the professional librarian overtime, previous or current legislation, professionalization and political initiatives related to the theme. In the face of all these aspects it has been found that the school library is present in several speeches, but in a few schools. Trata sobre a realidade da biblioteca escolar, diante da Lei 12.244/10 de Universalização das Bibliotecas Escolares, em contexto histórico educacional, iniciado no período colonial, mostrando suas transformações ao longo do tempo. O objetivo geral é de buscar compreender o contexto no qual está inserida a biblioteca escolar brasileira, através de sua origem, parâmetros que a normatizam, sua função na escola; e como objetivo específico demonstrar a realidade da biblioteca escolar diante da referida Lei. A metodologia adotada deu-se através de pesquisa bibliográfica e documental utilizando-se de fatos históricos, legislação, dados estatísticos e outras bibliografias referentes ao tema. Direcionou-se a seleção documental através de assuntos que tratam da presença ou ausência da biblioteca na escola, o papel do profissional bibliotecário ao longo do tempo, legislações anteriores ou vigentes, profissionalização e iniciativas políticas relacionadas com o tema da biblioteca escolar.
